California consumer privacy notice

1. About This Notice

This notice supplements the Modus Privacy Policy with information required for California residents under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, the "CCPA"). DSP Solutions, Inc. ("Modus") is the business responsible for your personal information. Read this notice together with the Modus Privacy Policy, which describes what personal information Modus collects, how it is used, who receives it, how long it is kept, and how it is secured.

If you are not a California resident, different privacy rules may apply. EEA, UK, and Swiss residents should see the Modus GDPR Privacy Notice.

2. Categories of Personal Information We Collect

Over the past twelve (12) months, Modus has collected the following categories of personal information as defined under California Civil Code Section 1798.140:

  • Identifiers: name, email, shipping and billing addresses, phone number, IP address, device identifiers, account login credentials
  • Customer records under Section 1798.80(e): name, address, phone number, credit card information in tokenized form via the payment processor, purchase history
  • Commercial information: products purchased, products viewed, cart contents, transaction history, returns
  • Internet or other electronic network activity: browsing history on modusglobal.com, search queries, interaction data, referral URLs
  • Geolocation data: approximate location derived from IP address at country, state, and city level
  • Audio, electronic, or visual information: customer service call recordings where permitted by law and with notice, photos or videos submitted voluntarily with reviews
  • Inferences drawn from the above to create consumer profiles for marketing and product recommendations

Modus does not collect biometric information, genetic data, or professional or employment-related information from site visitors.

3. Categories of Sensitive Personal Information

Modus collects the following limited categories of sensitive personal information under the CCPA:

  • Account login credentials: username and password for modusglobal.com accounts
  • Precise geolocation data: not collected

Under the CCPA as amended by regulations effective January 1, 2026, personal information of consumers under 16 is treated as sensitive personal information. modusglobal.com is not directed to children under 16, and Modus does not knowingly collect personal information from consumers under 16 (see the Children's Privacy section of the Modus Privacy Policy). If Modus learns that personal information of a consumer under 16 has been collected, Modus treats that information as sensitive personal information and handles it accordingly.

Modus uses sensitive personal information only as needed for the services you request, such as account authentication. Modus does not use sensitive personal information for purposes that would trigger the right to limit use under CCPA.

4. Categories of Third Parties We Disclose To

Modus discloses personal information to the following categories of recipients. For each category, Modus has indicated the categories of personal information disclosed in the preceding twelve (12) months.

Service providers and contractors:

  • Payment processors: identifiers, customer records, commercial information
  • Shipping and logistics providers: identifiers, customer records, commercial information, geolocation
  • Cloud hosting and e-commerce platform: all categories listed in Section 2
  • Email and marketing platform: identifiers, commercial information, internet activity, inferences
  • Customer service software: identifiers, customer records, commercial information, audio or visual information from customer service interactions
  • Analytics providers: identifiers, internet activity, geolocation, inferences
  • Fraud detection services: identifiers, customer records, commercial information, internet activity, geolocation
  • Customer review platforms: identifiers (name, email), audio or visual information (review photos and videos you submit)
  • Professional and legal advisors: as needed for the advice provided

Third parties:

  • Advertising partners, for cross-context behavioral advertising (see Section 5): identifiers, internet activity, commercial information
  • Governmental authorities and regulators, in response to lawful requests: as required by the request
  • Parties involved in a business sale, merger, or restructuring: categories needed for the transaction

5. Sale and Sharing of Personal Information

Under the CCPA, "sale" and "sharing" have specific meanings. "Sale" means disclosing personal information for monetary or other valuable consideration. "Sharing" means disclosing personal information for cross-context behavioral advertising.

  • Sale: Modus does not sell personal information in exchange for monetary consideration.
  • Sharing: Modus uses advertising cookies and pixels that may constitute "sharing" under the CCPA since they involve disclosing identifiers and browsing information to advertising partners for cross-context behavioral advertising.

Categories of personal information shared for cross-context behavioral advertising:

  • Identifiers: IP address, device identifiers, cookie IDs
  • Internet or other electronic network activity: pages viewed, products viewed, purchases
  • Commercial information: products purchased

Modus does not knowingly sell or share personal information of California residents under the age of 16.

Your right to opt out of sharing: You can opt out of sharing by clicking the "Do Not Sell or Share My Personal Information" link in the modusglobal.com footer, or by turning on the Global Privacy Control (GPC) signal in your browser. Modus honors the GPC signal as a valid opt-out request.

6. Your California Privacy Rights

California residents have the following rights under the CCPA:

  • Right to know (Sections 1798.110 and 1798.115). Request disclosure of the categories of personal information Modus has collected, categories of sources, business and commercial purposes, categories of recipients to whom personal information was disclosed, sold, or shared, and specific pieces of personal information Modus has about you. If Modus retains personal information about you for longer than twelve (12) months, you may request access to personal information collected before that twelve-month window, going back to January 1, 2022. You can specify a date range in your request, or request all personal information retained.
  • Right to delete (Section 1798.105). Request deletion of personal information Modus has collected from you, subject to legal exceptions.
  • Right to correct (Section 1798.106). Request correction of inaccurate personal information.
  • Right to opt out of sale or sharing (Section 1798.120). Direct Modus to stop selling or sharing your personal information. Modus does not sell personal information. To opt out of sharing, see Section 5.
  • Right to limit use of sensitive personal information (Section 1798.121). Limit Modus's use of sensitive personal information to the purposes needed to provide the services you request. Modus does not use sensitive personal information beyond these purposes, so this right is functionally available without action.
  • Right to non-discrimination (Section 1798.125). You will not be denied services, charged different prices, or provided lower-quality service for exercising a privacy right.

7. How to Submit a Request

To submit a privacy rights request, use one of the following methods:

8. Authorized Agents

You may designate an authorized agent to submit a privacy rights request on your behalf. Modus will require one of the following:

  • Written permission signed by you authorizing the agent
  • Verification of your identity with Modus directly
  • A legal document authorizing the agent to act on your behalf under California Probate Code

9. Verification of Requests

Modus verifies the identity of the person submitting a request before responding. For requests to know or delete personal information, Modus matches information you provide against information in Modus's records. The verification level matches the sensitivity of the request and the risk of unauthorized access.

Opt-out of sharing requests do not require identity verification.

10. Response Timeline

Modus confirms receipt of your request within ten (10) business days and responds substantively within forty-five (45) calendar days. Modus may extend the response period by an additional forty-five (45) days if needed, and will notify you of any extension within the initial response period.

11. Non-Discrimination

Modus does not discriminate against California residents who exercise their privacy rights. You will receive the same products, prices, and quality of service whether or not you exercise any right under the CCPA.

12. Shine the Light

California Civil Code Section 1798.83, known as the "Shine the Light" law, allows California residents to request information about Modus's disclosure of personal information to third parties for those third parties' direct marketing purposes. Modus does not disclose personal information to third parties for their own direct marketing purposes.
