1. About California Proposition 65

California Proposition 65, formally the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses selling products in California to provide warnings about exposure to chemicals known to the State of California to cause cancer, birth defects, or other reproductive harm.

The chemical list is maintained by California's Office of Environmental Health Hazard Assessment (OEHHA) and contains more than 900 substances. Many of these substances appear in everyday consumer products across industries, from automotive components to household electronics.

2. Why You See These Warnings on Modus Products

Modus builds mobile audio, marine audio, and related electrical accessory products. Some of these products contain small amounts of substances on the Prop 65 chemical list. The substances are present in parts and materials common to electronics manufacturing, including:

  • Lead in solder joints, brass terminals, and wire jacket stabilizers
  • Phthalates, including DEHP and DINP, in flexible PVC cable insulation
  • Nickel in plated connectors and mounting hardware
  • Styrene in certain plastic housings and components
  • Carbon black in speaker cones and rubber surrounds

Prop 65 requires a warning when a listed substance is present, regardless of whether exposure from product use approaches any health-based threshold. Modus provides warnings to meet California disclosure requirements.

3. What the Warnings Look Like

Modus products sold into California that contain listed substances carry product-specific safe-harbor warnings adopted by OEHHA in 2025 for motor vehicle parts and recreational marine vessel parts.

For Modus automotive audio products:

⚠ WARNING: Handling passenger or off-highway motor vehicle parts can expose you to chemicals such as phthalates and lead, which can cause cancer and reproductive harm. To minimize exposure, service the vehicle in a well-ventilated area, wear gloves, and wash your hands. For more information see P65Warnings.ca.gov/motor-vehicle-parts.

For Modus marine audio products:

⚠ WARNING: Handling recreational marine vessel parts can expose you to chemicals such as phthalates and lead, which can cause cancer and reproductive harm. To minimize exposure, service the vessel outdoors or in a well-ventilated area, wear gloves, and wash your hands. For more information see P65Warnings.ca.gov/marine-vessel-parts.

Modus may use the alternative signal words "CA WARNING" or "CALIFORNIA WARNING" in place of "WARNING" on products and packaging sold in markets outside California. Products manufactured and labeled before January 1, 2028, may carry older-format warnings under the three-year grace period set by OEHHA. From that date forward, Modus will use the product-specific safe-harbor warnings shown above.

The warnings appear on product packaging, product detail pages on modusglobal.com, and at point of sale where required by California law.

4. What These Warnings Do Not Mean

A Prop 65 warning on a Modus product does not mean any of the following:

  • The product violates a federal safety standard
  • The product is unsafe for its intended use
  • Exposure from the product exceeds levels that cause harm
  • The product should not be purchased or used

Prop 65 sets California-specific disclosure thresholds that differ from federal regulations issued by agencies such as the Consumer Product Safety Commission (CPSC) and the Environmental Protection Agency (EPA). A warning reflects the presence of a listed substance, not a determination of risk to the customer.

Modus products are engineered to meet applicable United States safety standards for mobile and marine audio equipment. Like many businesses selling consumer electronics into California, Modus provides Prop 65 warnings as a precaution when listed substances are present in components or materials. California law imposes significant penalties for failure to warn, and no penalty applies to providing a warning when one is not strictly required. The presence of a warning reflects this cautious compliance posture, not a determination about exposure or safety.
